Terms of service
These are the terms on which you use Throwcast during its beta. They are short because the arrangement is simple: it is free, it is provided as it is, your projects are yours, and its numbers are a plan rather than a measurement. How we handle personal data is set out in the Privacy notice, which forms part of these terms.
Who you are dealing with
Throwcast — the application at studio.throwcast.app, the sites at throwcast.app and manual.throwcast.app, and the email we send — is operated by an individual entrepreneur registered in Ukraine, trading as Throwcast. Full registration details are available on request at hello@throwcast.app. These terms are an agreement between you and that person, referred to here as “we”.
Throwcast is a professional tool for people who plan and rig projection. By using it you confirm that you are acting in the course of a business or profession, and that you are at least 18.
The beta
Throwcast is in a closed beta. Access is by invitation and free of charge. We may change any feature, and may suspend or end the beta or the service, at any time; where we can, we give account holders notice by email. If the service later changes in a way that affects your access — including a move to paid plans — we will tell you at least 30 days in advance, and you will keep the ability to export your projects throughout.
Your account
An account is for one person. Keep your password to yourself, and tell us at hello@throwcast.app if you think someone else has used it. You are responsible for what is done through your account. An invitation is personal: rather than passing your login on to a colleague, ask us to invite them — or, if they only need to look at a project, send them a link to it instead.
Your projects
Everything you put into a project — venue models, drawings, images, the rig you design and the reports you print — is yours. We claim no rights in it. You give us only the permission we need to store it, show it back to you and keep backup copies, for as long as you keep it with us.
You are responsible for having the right to upload what you upload. A client’s drawings are usually the client’s property; by uploading them you confirm you are allowed to.
We treat project content as confidential. We do not look at it except in a read-only mode, to help with a problem you have reported or to investigate abuse, and every such access is logged. The Privacy notice says how.
You can export any project as a file from the app at any time. That will always be available. If we end the beta or close the service, we will give you at least 30 days to export before anything is deleted. If you ask us to delete your account, we delete it and every project in it.
Sharing a project
You can create a link that opens one of your projects for anyone who has it, with no account and no signing in. They see the project as it stands — the venue, the rig, the reports — and they can look, measure and print. They cannot change anything, and the link reaches that one project and nothing else in your account.
Treat the link as a key. It is a long, unguessable address and it is not protected by a password, so anyone it is forwarded to can open it exactly as you could. We do not publish or list these links anywhere, but once you send one we cannot control where it travels.
A link keeps working until you revoke it. You can revoke one at any time from the app; it stops working immediately, for everyone, and cannot be brought back — create a new link to share again.
What you share, and with whom, is your decision. Where a project holds a client’s drawings or anything else you were given in confidence, make sure you are allowed to show it before you send the link.
A design aid, not a measurement guarantee
Throwcast simulates light and geometry from the figures you give it and from the figures in its catalogue. Everything it produces — lux levels, image sizes, overlaps, throw distances, pixel density, cable lengths, and every number on a report — is a planning estimate. Real projectors, lenses, screens, surfaces, ambient light and rigging differ from their datasheets and from any model.
We do not warrant that a simulated result will match what is measured on site. You are responsible for verifying a design on site before anyone relies on it, for the safety of any rig built from it, and for complying with the rules that apply where it is built.
The catalogue
Device specifications in Throwcast are reproduced from the manufacturers’ published data, for convenience. Throwcast is not affiliated with or endorsed by Epson, Panasonic or any other manufacturer. Figures may be out of date or transcribed with errors: verify against the current datasheet before ordering.
Fair use of the service
Do not attempt to reach accounts, projects or systems you have not been given access to; interfere with or overload the service; upload anything malicious, unlawful, or that you have no right to upload; extract the catalogue for redistribution; resell access, or give your own sign-in to somebody else; or use the service for anything illegal. We may suspend or close an account that does, giving notice and time to export where we reasonably can.
Provided as it is
Throwcast is provided as it is, without warranty of any kind, express or implied, including any warranty of fitness for a particular purpose or of uninterrupted or error-free operation. We make no commitment to availability, and during a beta things break: keep your own exports of anything you cannot afford to lose.
To the extent the law allows, we are not liable for any indirect or consequential loss, lost profits, lost data, or any loss arising from reliance on a simulated result, and our total liability to you in connection with the service is limited to the amount you have paid us for it — which, during the beta, is nothing. Nothing in these terms excludes or limits liability that cannot be excluded by law.
Changes to these terms
When these terms change, the date at the top changes with them, and account holders are emailed about anything material at least 14 days before it takes effect. Using the service after that date is acceptance of the change. If you do not accept it, export your projects and stop using the service; we will delete your account on request.
Governing law
These terms are governed by the law of Ukraine, and any dispute is for the courts of Ukraine. If, despite the section above, you use the service as a consumer, any protection the law of your country gives you that cannot be waived remains yours.
